1. Introduction

Welcome to BIMthinker (“Company”, “we”, “our”, “us”)! These Terms of Service (“Terms”) govern your use of our website located at https://www.bimthinker.com/ (together or individually “Service”) operated by BIMthinker. Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages. Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound by them.

Some parts of Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or BIMthinker cancels it.

6. Free Trial

BIMthinker may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").

7. Fee Changes

BIMthinker, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions.

8. Refunds

We issue refunds for Contracts within 30 days of the original purchase of the Contract.

9. Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.

Content found on or through this Service are the property of BIMthinker or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

10. Prohibited Uses

You agree not to use Service in any way that violates applicable laws, infringes upon the rights of others, or involves the use of any robot, spider, or other automatic device to monitor or copy the material on Service without our prior written consent.

11. Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

12. No Use By Minors

Service is intended only for access and use by individuals at least eighteen (18) years old.

20. Limitation Of Liability

EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF COMPANY, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES.

21. Termination

We may terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under our sole discretion.

22. Dispute Resolution (Borderless Framework)

22.1. Informal Resolution: As a specialist-led platform, we value direct communication. In the event of any disagreement or technical dispute, you agree to first contact us directly at smarbimsolution@gmail.com to seek an amicable, informal resolution.

27. BIM Asset Usage & Technical Disclaimer

27.1. Brand Persona & Identity: BIMthinker is a professional brand persona and digital repository. All services, communication, and intellectual property are issued under the BIMthinker brand.

27.2. Global Usage & Compliance: Users accessing the Service are responsible for compliance with their local building codes, professional engineering standards, and intellectual property laws.

27.3. Nature of Assets (LOD): All BIM models and digital elements are provided primarily for illustrative, conceptual, and preliminary planning purposes (generally aligned with LOD 200/300). They are not intended for fabrication, procurement, or final construction documentation without independent verification by the user's Professional of Record.

27.4. Protection of Parametric Logic: The "Intellectual Property" defined in Section 14 specifically includes the "Digital Architecture" of our files—including but not limited to parametric formulas, nested family structures, shared parameter GUIDs, and organizational database schemas. Users are strictly prohibited from reverse-engineering or redistributing the underlying logic as a competing commercial product or library.

27.5. Technical Limitation of Liability: BIMthinker is not liable for data corruption or inaccuracies resulting from software versioning, cross-platform interoperability (e.g., IFC translations), or third-party plug-ins.

28. Professional Collaborations & Third-Party Services

28.1. Collaborative Authorship: BIMthinker may collaborate with third-party consultants, engineers, or BIM specialists to develop specific Service Content. While these collaborators may be credited for their contributions, the final integrated digital architecture remains under the management and brand protection of BIMthinker. 28.2. Supplier-Provided Data: Where the Service includes model elements or specifications provided by third-party suppliers:

• (i) Such data is provided for coordination and convenience only.

• (ii) BIMthinker does not verify the real-world manufacturing tolerances or availability of supplier products.

• (iii) The inclusion of supplier data does not constitute a professional endorsement by BIMthinker. 28.3. Consultant Advisory: Any technical advice, tutorials, or "know-how" shared by consultants via the Service is provided as general information. All project-specific decisions must be validated by the user’s local Professional of Record.
